Definitions

‘We’, ‘us’, ’our’ and ’UX Playground’ refers to UXPG Limited.

‘You’, ‘your’ and ‘users’ refers to all visitors using uxplayground.co.uk and associated services.

‘Community member’ refers to people who have signed up to become a member via Meetup.com or uxplayground.co.uk.

‘Participant’ refers to potential or actual UX Playground community member attending projects.

‘Attendee’ refers to potential or actual UX Playground community member attending events.

‘Stakeholder’, ‘client’ and ‘partner’ refers to a company or individual that have an involvement in events or projects.

Introduction

UXPG Limited owns and/or operates the website located at www.uxplayground.co.uk (hereinafter, “Website”).

These Terms of Service (the “Terms”) contains the agreement and policies under which UXPG Limited (hereinafter,

“UX Playground”) provides services to you and describes how the Website, services, features and applications accessible through, or in connection with, the Website, including without limitation your enrollment in any projects and events (collectively, the “UX Playground Services”) can be accessed and used. The Terms govern your use of UX Playground Services, addressing your legal rights and obligations, including important disclaimers, so please read the following carefully:

 

By accessing or using any part of the Website or, purchasing and accessing any of UX Playground Services, you agree

that you have read, understood, and agree to the Terms.

 

Revision to Terms —

UX Playground has endeavoured to ensure that the information and prices provided on the Website and our Terms is accurate. We reserve the rights to revise these Terms at any time at our own discretion. If we make changes to these Terms, this will be updated on the Website with a date of when it was last revised. We will email all our users if any major changes made to the Terms make be of concerns or requires attention.

Using UX Playground Services

Who can use our services  

UX Playground believe in diversity and inclusivity, therefore anyone is welcome to use our services. Due to legal reasons, we must specify that if you are under 18, you represent and agree that you possess the legal consent of your parent or guardian to access and use the UX Playground Services.

 

International users — 

The UX Playground Services are operated from the United Kingdom, but may be accessed in other parts of the world. 

 

If you are located outside of the United Kingdom and you access or use the UX Playground Services, you acknowledge, understand and agree that you are doing so on your own initiative and at your own risk. It is your responsibility to make sure that your use of the UX Playground Services complies with all applicable local laws in the jurisdiction from where

you access or use the UX Playground Services. 

 

By submitting any personally identifiable information to us through the UX Playground Services, you consent to the transfer, processing and storage of your information in the United Kingdom in accordance with our Privacy Policy.

Becoming a UX Playground community member

To become a UX Playground community member, you have two options of signing up, via the Website or Meetup.com

UX Playground group [https://www.meetup.com/UX-Playground-The-User-Experience-Meetup-for-Londoners].

No administration fee is required. By signing up, you consent to receiving updates on upcoming events either directly

us or Meetup.com. 

Via Meetup.com —

You can simply join the UX Playground group via Meetup.com [https://www.meetup.com/UX-Playground-The-User-Experience-Meetup-for-Londoners]. To register your interest in attending a UX Playground event, RSVP on the corresponding event page via Meetup.com UX Playground group page. Please review Meetup.com’s Terms of Service

and Privacy Policy, before signing up. 

 

Via our Website —

To become a member you can join our mailing list via our Website. The data will be captured via Mailchimp.

Becoming a project participant

In order to participant in a project, you must register via the Website. UX Playground use a third-party service, POWr, to allow you to register your details to enroll onto a project. By submitting a registration form, you acknowledge that the information you provide will be transferred to POWr for processing in accordance with their Privacy Policy and Terms.

 

Your registration is not complete until a payment in full or as a first installment is processed and approved. Please review our Payment, Cancellation & Refund Policy and Privacy Policy.

Becoming a partner

If you would like to partner with UX Playground as a speaker, sponsor or project stakeholder, please contact us at admin@uxplayground.co.uk.

Payment, Cancellations and Refund Policy

When registering to enrol onto a project, you will be redirected to our secure payment process via Stripe to complete your purchase.

 

Any credit or debit card payment will be taken securely through Stripe’s payment system. All credit or debit card information are handled by Stripe, not UX Playground.

Payment Options

Payment can only be made online via the Website. At this stage, we will not be accepting bank transfers or cheques.

 

One-off payment —

Full payment must be made by the project enrolment date. Failure to do so, we reserve the right to refuse access

to the project.

Instalment payment —

Payment on behalf of a group or individual  —

If you are looking to make a payment on behalf of a group or individual, please contact us on admin@uxplayground.co.uk.

Delay to instalment payments

As soon as you are aware that there is any delay to your current instalment, you must notify us immediately, and payment must be made no later than 14 days before the next installment is due. Failure to do so, you will no longer be able to continue the project and no refund will be made.

 

Cancellations by UX Playground 

Cancelling or rescheduling — 

UX Playground strive to provide the best experience but we are not responsible for any issues you may experience that

is beyond our control. For more details, please read our Liability and Acceptance Use Policy. 

 

UX Playground reserve the right to substitute speakers and facilitators, or cancel project sessions and events.

We endeavour to notify you at the earliest possible notice via email and other communications channels.

 

Our liability is limited to carrying over your payments if a project or event has been rescheduled. Only when there is a cancellation that UX Playground are responsible for, will we be liable to refunding the project registration fees or event tickets of the affected days that you had already paid. Please read our Liability and Refund Policy for more details.

 

Speaker substitution — 

Speakers may need to be substituted in case of illness, accidents, travel problems, or other issues that prevent a scheduled speaker from presenting as planned. UX Playground will endeavour to get a substitute speaker, but this may

not always be possible because of the expertise required and the short notice available in most such cases.

Cancellations by Users

[If a written notice has not been received or it is made after the refund deadline, we reserve the right to not give a refund, as detailed in our Refund Policy.]

If a participant must cancel before or after the start of a project, a written notice via email must be provided to the UX Playground team at admin@uxplayground.co.uk

 

Once received and approved, a refund (excluding transaction fees) will be made as follows:

 

Full refund of the original payment - Up to one week before starting a project

 

80% of the original payment - Up to two weeks after starting a project

Transfer attendance — 

If you can no longer attend a project or a paid event but would like to transfer the attendance to another person, please notify us at admin@uxplayground.co.uk. The minimum we require for project attendance is that the new participant is able to meet the criteria outlined in the Agreement.

Refund Policy

All refunds will be made to the same card that was used to pay for the UX Playground Services. UX Playground will process the refund by Stripe. If the original charge underwent currency conversion, the refunded amount converts back using the same process. There are no fees to refund a charge, but the fees from the original charge aren’t returned. 

 

Stripe will submit refund requests to your bank or card issuer. You can see the refund as a credit approximately 5-10 business days later, depending upon the bank. Once issued, a refund cannot be cancelled. You will be notified by Stripe

of the refund via email.

 

We reserve the right to not give a refund, if the following has occurred:

 

- If we have concerns of fraudulent use

- A written request for a refund has not be received ahead of the refund deadline

Code of Conduct

[You are responsible for respecting and adhering to our Code of Conduct to ensure the balanced harmony of our community and the quality of sharing advice and knowledge amongst the UX Playground members are maintained.]

 

All attendees, community members, participants, sponsors and volunteers using UX Playground Services are required to agree with the following code of conduct. Organisers will enforce this code throughout events and project sessions. We expect cooperation from all community members to help ensure a safe environment for everybody.

Our philosophy —

UX Playground’s philosophy of learning is through Collaboration, Exploration and Play. To get the best out of the UX Playground Services, it is advised that users and community members ensure that they adhered to UX Playground’s philosophy.

Respecting each other —

UX Playground promote diversity and welcome people from various backgrounds and experiences to become part of our community. We are dedicated to providing a hassle-free environment for everyone. We will not tolerate harassment of any form such as any discrimination against race or ethnic origin, religion or philosophical beliefs, sexual orientation, disability or impairments, or other sensitive matters. 

 

If community members engage in harassing behaviour to a fellow community member or any of the UX Playground team, we will take any action that deems appropriate, including warning the offender, or expulsion from UX Playground Services. If you are being effected, please reach out to one of our staff members. This includes harassment between community members whilst using UX Playground Services, as detailed in our Acceptance Use Policy.

Acceptance Use Policy

[You agree to abide by all applicable laws, regulations and codes of conduct and ensure that any material uploaded or distributed or stored by you does not infringe the rights of others.]

It is not necessary for a user to disclose personally identifiable information to the public when using the Website. It is each user’s decision as to whether they add or share personal information and opt to make these visible to other users.

 

You are prohibited from posting or transmitting any “sensitive” personally identifiable information over the Website, which may include, but not be limited to, any information about yourself or another person that may relate to: 

 

- health or medical conditions

- social security numbers or national identifiers

- credit card, bank account or other financial information

- sex life, political opinions, criminal charges or convictions,

- religious or philosophical beliefs

- racial or ethnic origin

- other sensitive matters

Intellectual Property and Copyright Policy

[UX Playground respects the intellectual property right and copyrights of our users, and partners. We expect our users to do the same when using the UX Playground Services. You agree not to reproduce, duplicate, copy or re-sell any part of our Website or learning platform in contravention of the provisions of our Terms of Service.]

All logos, content (including our Website’s structure and layout), graphics, images, photographs, animation, videos, text and software used on this Website are our intellectual property or that of our partners or other users.

 

We are copyright protected which prevents people from copying, modifying, downloading, reverse engineering (unless permitted by applicable law) or creating extracts of, or derivative works from, such material without our specific prior written consent.

 

We do not claim any ownership of any intellectual property rights of the participant content that has been submit during their involvement in the course or project.

Disclaimer

The Services, project materials and all information provided or produced by UX Playground are on an “as if” basis, and in good faith. All content provided by third-parties and/or users such as testimonials of our Services, reflect the real-life experiences and opinions of such users. The content are reviewed by UX Playground before being posted. We make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability or completeness of any information on the Website.

 

Under no circumstance shall we have any liability to you for any loss or damage of any kind incurred as a result of your access and use of the Services, or reliance on any information provided on the Website. You acknowledge and agree that any access or use of the Services, or such content is at your own risk.

Liability

UX Playground act solely as a design professionals for sharing advice and knowledge offered to you.  We endeavour to provide the best experiences when facilitating workshops, project sessions or events, but we are not liable for any loss, damage or inconvenience you experience as a result of:

 

- using this Website or any associated UX Playground Services

- contacting us by email

- using our online chat

- misplacing personal belongings or left unattended at UX Playground events

- personal injury during use of UX Playground Services

- technical issues, such as downtime on your internet provider or hardware issues, during projects or events

- natural disasters or pandemic

 

Whilst UX Playground makes every effort to monitor the experience fulfilled by our third-party partners, any liability incurred by the user or the recipient caused by the third-party partner’s negligence is the responsibility of the third-party partner and not UX Playground. 

 

Any partnership agreements you make with UX Playground on behalf of your own company, or the company you work for, to allow their employees to access or use our Site or Services, you take full responsibility for your employees and you guarantee UX Playground against any claim resulting from your employee’s breach of these Terms.

 

If you have a complaint concerning the specific services provided by UX Playground, you must inform us immediately in writing within 48 hours. We regret we cannot accept any liability if we are not notified.
